This is the Privacy Policy of Gripsta Gear and its affiliated companies and subsidiaries (collectively, “Company”) regarding your use and interaction with Company and its “www.gripsta.com” website and all related software applications, websites, portals and cloud servers (collectively, the “Application”).  By using our Application, you consent to this Privacy Policy, as amended from time to time.



This online privacy policy applies only to information collected through our website and not to information collected offline.


Any capitalized terms not defined herein shall have the meaning ascribed to them in the Terms of Use https://gripsta.com/policies/terms-of-service which are incorporated herein by reference (the “Terms”).  In the event of a conflict between this Privacy Policy and the Terms, the provisions of this Privacy Policy will prevail.



How We Collect and Use Your Personal Information


To provide the Services, we collect and have collected over the past 12 months personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.


In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide the Services, comply with any applicable legal obligations, enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.


We will not sell, share, or rent this information to others in ways other than those outlined in this Privacy Policy. Company collects information from our users at several different points on the Application. Personal Information (defined below) provided by users (“you”) will be used by Company to improve the Application and provide a more personalized experience for the user, but information which identifies a specific individual will not be disclosed to others without the user’s permission unless necessary to provide services which the user has requested.

From what sources do we collect sources of personal information?

Information We Collect Directly from You


Information that you directly submit to us through our Services may include:

  • Basic contact details including your name, address, phone number, email.

  • Order information including your name, billing address, shipping address, payment confirmation, email address, phone number.

  • Account information including your username, password, security questions.

  • Shopping information including the items you view, put in your cart or add to your wishlist.

We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. How do we use your personal information?

We may use your personal information for the following purposes:

  • Transactional Purposes: We use your contact information, financial information, and commercial information to:

    • Place, process, confirm, send and track your order, subscription and registration; 

    • Communicate with you about your order, subscription or registration, including when you use the chat feature on our websites; and

    • Process any subscription or registration you make to one of our services.

Our Service Providers

We may contract with companies or persons to provide certain services, including operating the website, hosting the website, providing the products and services you request, authorizing and processing your payments, product fulfillment, fraud protection and credit risk reduction, product customization, marketing and promotional material distribution, loyalty program management, promotions fulfillment, web site evaluation, data analysis and, where applicable, data cleansing. Our Affiliates

We may use technology that maintains a record of your browsing session. We use this information for quality control, customer service, fraud prevention and security, and marketing purposes.

WHAT ABOUT THE PRIVACY OF CHILDREN UNDER 13?

We do not intend to collect personal information from anyone who is under the age of 13. If you are under the age of 13, you should not provide any personal information to us and you should use this website only with the involvement of a parent or guardian. We reserve the right to retain any personal information reasonably necessary to appropriately document our business activities, for archival and record retention purposes, or as otherwise required by applicable law. CAN I INDICATE WHETHER OR NOT I WANT TO RECEIVE PROMOTIONAL COMMUNICATIONS?
 
You always have the choice to stop receiving email and SMS marketing communications. There are several ways in which you can tell us whether or not you want to receive promotional communications from us.  You can change your promotional email subscription preferences by clicking on an "unsubscribe" hyperlink contained in promotional emails we send you. Please note that "opting-out" of receiving promotional emails will not stop marketing or advertising content that is generated for distribution or is otherwise queued for transmission to you before we can implement your request.  For SMS marketing, you can reply “STOP” to any text message to stop receiving marketing text messages from the applicable short code. You may also request that we correct any inaccurate information that we have about you.

To submit a request to know, a request to correct, a request to obtain a third-party disclosure list, or a request to delete, please contact policies@gripsta.com In order to verify your identity, we will need the name, address, phone number and email address associated with the account. In order to designate an authorized agent to act on your behalf, you must provide the authorized agent with written permission to do so, and your authorized agent must submit that written proof at the time they make the request on your behalf. If you make multiple requests under this section, we recommend sending the deletion request last, as we will not be able to fulfill your other requests once we have deleted your information. For a faster way to correct your contact information, as described above, you may go to the “My Account” section of your account to correct it yourself.

Do Not Sell or Share/Use My Personal Information for Targeted Advertising

Under California law, “share” means disclosing your personal information by us to a third party for cross-context behavioral advertising, in exchange for money or anything else of value. Thus, when we use the term “share” under this section, we are using it in the narrow meaning of how it is defined under California law. Other State Privacy Laws do not use the term “share,” but describe the activity as using personal information for targeted advertising.

Under the laws of California, Colorado, Connecticut, Montana, Oregon, Texas, and Utah, “sell” means exchanging your personal information by us with a third party for money or anything else of value. Under Virginia law, “sell” is the exchange of personal information for money only.

We do not knowingly sell or share the personal information of minors under the age of 18, unless we obtain consent in accordance with State Privacy Laws.

Right to Opt Out of Sale or Sharing/Using your Personal Information for Targeted Advertising

We participate in digital advertising networks to deliver targeted advertising that is tailored to your interests. The participation in certain ad networks can constitute a “sale” of personal information, or “sharing/processing for targeted advertising” under State Privacy Laws. We do not “sell” or “share” sensitive personal information (as defined under State Privacy Laws).

Right to Opt out of Profiling

If you are a resident of California, Montana, Oregon, Texas, Virginia, Colorado, or Connecticut, you have a Right to opt out of any form of automated processing performed on personal information to evaluate, analyze or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, policies@gripsta.com. To opt out of cookie-based or digital advertising-based Profiling, please use our Cookie Preferences tool to toggle off “Advertising” and “Functional” cookies. Note that if you clear your cookies, your opt out request will no longer be saved. In order to verify your identity, we will send you a verification email. In order to designate an authorized agent to act on your behalf you must provide the authorized agent with written permission to do so, and your authorized agent must submit that written proof mailed to the address below so that it is received prior to the time the agent makes the request on your behalf. 

Note that we will not be able to opt you out of profiling where one of the following exceptions applies:

  • Legal: to comply with applicable laws, rules or regulations; to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by governmental authorities; to cooperate with law enforcement; to investigate, exercise, prepare for or defend actual or anticipated legal claims; or to assist another party with any of its obligations under applicable laws;

  • Transactional: to provide a product or service specifically requested by you; to complete a transaction with you or to complete a contract we have with you; and

  • Public Interest: to protect your vital interests or those of another individual.

Non-Discrimination

We will not discriminate against you for exercising any of your Rights under State Privacy Laws and we will not deny you goods or services, charge you a different price, or provide you with a lesser quality of goods or services if you exercise any of your Rights.

Sensitive Personal Information

We do not collect or process sensitive personal information, as defined by California Law, for inferring characteristics or use or disclose sensitive personal information for purposes other than those permitted by law.

Right to Appeal

If you are a California, Colorado, Connecticut, Oregon, Texas, Montana, Virginia, or Utah resident and we were unable to fulfill your request, you may appeal our request by emailing us at policies@gripsta.com within fourteen days of our decision, including “Appeal Request” in the subject line, with a detailed reason for your appeal, as well as your state of residence.

HOW LONG DO YOU KEEP MY INFORMATION?

We will store your personal information for as long as is reasonably necessary to fulfill the purposes described in this Privacy Policy or as required by law.

Our digital operations are conducted, in whole or in part, in the United States. Regardless of where you live, you consent to have your personal information transferred, processed, and stored in the United States, and allow Company to use and collect your personal information in accordance with this Privacy Policy.
